The Namibia Sports Commission's (NSC) appeal committee, consisting of Dr Donovan Zealand, Loini Shikale-Ambondi and Marius Kudumo, ruled yesterday that the NSC’s refusal to register the Namibia Premier League as an independent sport body was unlawful.

This means that the NSC needs to reconsider the application and make a new decision which is in compliance with the Sport Act, the Namibian constitution and the common law.

How it transpired

The NSC denied the NPL’s request to be registered, saying there could not be two football bodies operating in the country.

The NPL was expelled by the Namibia Football Association on 18 July 2020. The NPL then applied for registration as a separate national sports body on 31 July 2020. This application was rejected by the NSC. Aggrieved by the decision, the NPL appealed against the decision.

The reasons the NPL gave were that they were not guaranteed the right to freedom of association, neither were they guaranteed the right to practise any profession, nor to carry on any occupation, trade or business.

They argued that there was no registered national sports body responsible for professional football in Namibia at the time that they had submitted their application.

Also, in their oral submissions the NPL cited the example of Germany, which has two national sports bodies that co-exist, namely the German Football Association and the German Football League.

In addition, they cited the example of the Namibian Federation for Freshwater Anglers and the Namibian Seawater Angling Federation, which are both registered with the NSC.

The court ordered the NSC to make a new decision on the application by 30 April.
