The charges of culpable homicide against a hit-and-run incident suspect, who 13 years ago, allegedly caused the death of a nephew of the late Deputy Prime Minister Hendrik Witbooi was provisionally withdrawn in the Windhoek Magistrate''s Court.
The case against the 45-year-old Gideon de Waal, which was on Monday initially postponed to Friday, was later on Tuesday withdrawn after the police were not able to produce the case docket against the accused.
The accused allegedly - in a hit-and-run accident - caused the death of Dawid Dirk Petersen on 23 September 2003 in Robert Mugabe Avenue, Windhoek.
The matter was this week twice on the court roll for plea and trial. The defence counsel stated that the matter should be treated with priority since some of the witnesses died in the meantime.
Apart from culpable homicide, De Waal is also being prosecuted for failing to stop, failing to ascertain injuries and defeating or obstructing the course of justice.
The accused allegedly drove away from the scene of the accident and hid the car at the farm Rus en Vrede. The matter has been delayed for various reasons and at one stage was removed from the court roll. However, the State decided to pursue the matter again.
In the meantime, Magistrate Tuyenikelao Haikango, who was initially the presiding officer in the matter and asked by the Windhoek High Court to recuse herself, has died.
The State Prosecutor at the time has resigned from the position.
Magistrate Alweendo Sebby Venatius was on the bench.
